The CLIENT has requested that Absolute Certified Equipment Appraisals and Business Pty Ltd (hereafter called ‘THE APPRAISER’) prepare a desktop ‘online’ Summary Appraisal Report on the Machinery and Equipment listed on the Appraisal Item Register on a ‘sight unseen’ basis.

1. The APPRAISER will report the type of value requested by the client by researching the market and industry, apply an appropriate approach to value, and provide a written report of his/her findings.

2. The APPRAISER is indemnified against any and all issues that may arise from the use of this report. You agree to hold as harmless against and from any and all losses, claims, actions, damages, expenses or liabilities, including reasonable legal counsel, to which we may become subject in connection with this engagement. You will not be liable from our negligence.

3. You agree that in the event that we are judicially acted negligently in the execution of this engagement by a final inoperable court order, damages shall be limited to an amount not to exceed the fee received by us for this engagement.

4. Your obligation for indemnification and reimbursement shall extend to any controlling person at Absolute Certified Equipment Appraisals and Business Pty Ltd, including any Director, Officer, Employee, Subcontractor, Affiliate or Agent.

5. Possession of the Report does not confer any right of publication to any person or entity and this is expressly prohibited unless written authorisation is given by the APPRAISER.

6. If called on to defend this report by you to any other party, the APPRAISERS expenses and hourly rate will be billed on a monthly basis or as incurred and you agree to pay these fees immediately on presentation of an invoice.

7. The CLIENT will be responsible for legal costs incurred by the APPRAISER when defending this appraisal if so instructed by the CLIENT.

8. The CLIENT agrees and accepts, without reservation, that the Limiting Conditions as stated in the report will be acceptable.


To maintain the independence and impartiality of the requested report you agree to pay the fee, in full, prior to the appraisal commencement.

ACEA & Business Pty Ltd reserves the right to reject any application for appraisal services entirely at its own discretion at all times.
